Advice needed--Pyscho Roommate

HELP!!

So I am subletting a room in my house (a house that I am the only one on the lease) to this crazy woman who is very verbally abusive to me. I decided that it isn't working out and gave her 30 days notice today. The original agreement was that this was a month-to-month arrangement meaning either side could give the other 30 days notice if it wasn't working out.

Now (it is the first day of course) she is screaming at me, barging into my room telling me she isn't leaving until December 1st. She thinks this is the case becasue she paid me one month's rent deposit and since I am telling her in the middle of the month she is actually paid up until Dec 1st and doesn't have to leave until the date she is no longer paid up to. But that isn't the agreement, the agreement is 30 days notice. And I told her I would give her half of her last month's rent back.

Ughhh I am just venting, but this is a very big problem. She is mentally unstable and won't physically hurt me, but comes 1cm from my face and screams at me (this has happened at least 5 times this month so far) and I think I am going to explode.

So what can I do? How can I get her out? Is she right when she thinks she can stay until Dec 1st since she has one month deposit with me?



***if i had the money i would pay for her to get a hotel for the next two weeks just to get out of my life!!!

I don't know what your state's laws are but here's the deal in Colorado. #1 You must provide WRITTEN 30 day notice (notorized for your records). #2 You may have to officially file in court (I believe for a small fee.) In any case, a deposit does not have to be refundable and she DOES NOT have the right to stay until Dec 1. Keep track of every little piece of damage she may have done to your place. Basically, everything in writing and documented. As far as I know, once you have given the 30 day notice she HAS to be out by the 30th day. You should call your local police dept and see what your laws are and what you can do to protect yourself. Ask about a civil standby if she's not out by then. You can also record or keep track of her verbal abuse for a possible restraining order (if it gets to that point). Hope this info helps!

I agree with secrets!! give her 1/2 back and call the cops....You dont need to put up with crap like that....and after she leaves get the locks changed...

Did you have a written contract? I think that since your the only one on the Lease, you have all legal rights to give her the boot. If it gets any worse, I would call in the police and file a complaint. I would highly recommend putting your 30 days notice in some sort of legal form. Have it notarized or maybe even talk to your landlord and have him give her an eviction notice. Her deposit is exactly that...a deposite for say cleaning, painting, unpaid bills etc. IT DOSE NOT go toward last months rent. That would have been classified as "Last Months Rent" and not "Deposit"

I honestly have no idea what you can do about this situation, but just wanted to say, I AM SOOOO SORRY FOR YOU!!! This must be horrible! I am so blessed with my roommate that I sometimes forget life isn't always this kind. I think if I was you I would try to stay out of the apartment as much as I could. But I hope you find a better solution.

If she isn't on the lease throw her and her stuff to the curb! If she isn't and won't leave call the cops and get her arrested for tresspassing! Other than that, make her feel likes she's loosing her mind.

I was seriously thinking about doing that but its hard because even though she is evil to me I am a nice person...
All she does is scream so when I try to say anything she doesn't hear it, I had to tell her 5 times that I was kicking her out before it even hit her. So I guess if she is never listening I will have to physically kick her out. With heels on of course! jk...kind of

I understand about it being hard because you're a nice person. I have a hard time too, but after spending the last almost 10 years being crapped on by a key person in my life I had to develope a backbone in the area of saying I've had enough, get out, I'm done! Hell I've got some really nice spiked heals I'll loan you to use in booting her out of your house. They're black so you don't have to worry about blood stains, lol!
